Paragraph 22 lists the addenda as checkboxes. Below is the fact about the house or the deal that pulls each one in, and the deadline it drags along with it.
Form numbers here are the revisions currently in circulation. TREC republishes forms and the trailing number changes with the revision, so the footer of the form in hand is the authority on which one it is.
Facts about the house
Pre-1978Lead-Based Paint Addendum (TREC 56-0). Required by federal law, 42 U.S.C. 4852d, for target housing built before 1978. Box C(2) gives the buyer ten days after the effective date to have the property inspected, and if lead-based paint or hazards are present, until 14 days after the effective date to terminate by written notice, earnest money refunded. Box C(1) waives that opportunity.
POAAddendum for Property Subject to Mandatory Membership in a Property Owners Association (TREC 36-11). Not for use with condominiums. Paragraph A has four boxes for who obtains the Subdivision Information and by when. Once the buyer receives it there are 3 days to terminate, or until closing, whichever occurs first. Under box A(1), if the buyer never receives it the buyer may terminate any time prior to closing, as the sole remedy.
CondoThe resale contract is the wrong form. Its own header reads: Not For Use For Condominium Transactions. The residential condominium contract is a separate promulgated form.
MineralsAddendum for Reservation of Oil, Gas, and Other Minerals (TREC 44-3), when the seller keeps some or all of the mineral interest.
LocationThe statutory notice addenda, grouped under Statutory Disclosures and Notices on the 20-19: Coastal Area Property (33-2), Property Located Seaward of the Gulf Intracoastal Waterway (34-4), Propane Gas System Service Area (47-0), and Notice of Obligation to Pay Improvement District Assessment (53-0). Utility, water, drainage and district notices get listed on the fill-in line in ¶22. The form prints the warning: a seller's failure to provide applicable statutory disclosures and notices may give the buyer remedies or rights to terminate.
How the money is structured
LenderThird Party Financing Addendum (TREC 40-11). Holds the Buyer Approval window counted in days after the Effective Date, and Property Approval running to the 3rd day before the Closing Date.
Seller carrySeller Financing Addendum, when the seller finances part of the price.
AssumptionLoan Assumption Addendum. The 20-19 ¶22 adds a companion box for the Addendum for Release of Liability on Assumed Loan and/or Restoration of Seller's VA Entitlement.
Home saleAddendum for Sale of Other Property by Buyer, when the purchase depends on the buyer selling another home first.
AppraisalAddendum Concerning Right to Terminate Due to Lender's Appraisal. Its termination path is box (6) on the TREC 38-8, which requires delivering a copy of the appraisal to the seller.
Short saleShort Sale Addendum (TREC 45-2), when the payoff needs the seller's lender to approve.
Who is living in the house, and when
LeasebackSeller's Temporary Residential Lease (TREC 15-7). The form's own notice limits it: for use only when the seller occupies the property for no more than 90 days after closing.
Early move-inBuyer's Temporary Residential Lease (TREC 16-7). Same limit in the other direction: no more than 90 days prior to closing.
TenantAddendum Regarding Residential Leases (TREC 51-1), when a tenant is in place and the lease conveys.
Leased gearAddendum Regarding Fixture Leases, for leased solar panels, water softener, alarm, or propane tank staying with the house.
The offer behind the offer
Addendum for Back-Up Contract (TREC 11-8). The trap in it is the date. Paragraph H changes the effective date for performance to the date the buyer receives notice that the first contract terminated, and calls it the Amended Effective Date. The additional earnest money and additional option fee in paragraph A(2) are counted in days after that Amended Effective Date, not after the original one, and paragraph B carries its own Saturday, Sunday, or legal holiday extension for those two items.
Paragraph H also sets the outside date: if the first contract does not terminate on or before the date written there, the back-up contract terminates and the earnest money is refunded. Paragraph I adds that amending or modifying the first contract does not terminate it.
Tests, reports, and the ones that are always there
The 20-19 groups Authorizing Hydrostatic Testing and the Environmental Assessment, Threatened or Endangered Species, and Wetlands Addendum (TREC 28-2) under Additional Tests and Reports. The Non-Realty Items Addendum is a new ¶22 box on the 20-19.
On nearly every Texas resale the Seller's Disclosure Notice (TREC 55-1) is required under §5.008 of the Texas Property Code. It is handled by ¶7B of the contract rather than a ¶22 checkbox. On the 20-19, ¶7I adds the Seller's Water Disclosure with the same three-box structure and the same 7-days-after-receipt termination right.
