The Closing Date Lands on a Weekend or a Holiday

The contract has one weekend rule and it is not in Paragraph 9.

What ¶9A says

The closing of the sale will be on or before the date in the blank, or within 7 days after objections made under Paragraph 6D have been cured or waived, whichever date is later (the Closing Date). If either party fails to close the sale by the Closing Date, the non-defaulting party may exercise the remedies contained in Paragraph 15.

There is no weekend rollover for closing

The Saturday, Sunday, or Legal Holiday extension in 5A(2) is written for the earnest money, the option fee, and the additional earnest money. It does not reach Paragraph 9. The date written in the ¶9A blank is the Closing Date whatever day of the week it falls on.

The practical side runs on business days regardless of what the blank says: county clerks, title offices, and funding rails do not operate on a Sunday or a federal holiday. That is a fact about the plumbing, not a term of the contract.

The two extensions the form does contain

Late title cure. ¶9A moves the Closing Date on its own to 7 days after 6D objections are cured or waived, when that date is later than the one in the blank.

Casualty loss. ¶14: if the property is damaged after the Effective Date and the seller cannot restore it due to factors beyond the seller's control, one of the buyer's listed elections is to extend the time for performance up to 15 days, with the Closing Date extended as necessary.

Moving the date on purpose

Box (3) on the TREC 39-11 amendment reads: the date in Paragraph 9 of the contract is changed to ___, 20__. Like the rest of the amendment, it takes effect when both parties execute it.

Moving the Closing Date moves anything measured backward from it. Property Approval under the Third Party Financing Addendum runs to the 3rd day before the Closing Date, so it travels with the new date.

What missing it does

¶9A points straight at ¶15. Under ¶15, if the buyer fails to comply the seller may enforce specific performance, seek other relief provided by law, or both, or terminate and receive the earnest money as liquidated damages.
