The short answer

It moves. Paragraph 5A(2) gives the buyer three days after the Effective Date to deliver the earnest money and the option fee, and if that third day is a Saturday, a Sunday or a Legal Holiday, the deadline becomes the next day that is none of those.

A worked example

Effective Date Thursday, January 1, 2026. Three days later is not a business day, so delivery is due Monday, January 5, 2026.

Which holidays count?

Not every day the state closes. The 20-19 defines a Legal Holiday as the national holidays in Texas Government Code §662.003(a), plus exactly two state holidays: Juneteenth under (b)(4) and the Friday after Thanksgiving under (b)(6). Confederate Heroes Day, Texas Independence Day, San Jacinto Day, Lyndon Baines Johnson Day, December 24 and December 26 are Texas state holidays this contract does not adopt. Offices may be shut; the deadline does not move.
